Personal data is information relating to a person or information that relates to a person (e.g. name, address, postal address, telephone number, IP address) and that can be used to find out the identity of persons. 2. Data processing when visiting this website

Every time you visit our website, data is collected that is required to provide the website. These are

  • Date and time of retrieval
  • Your IP address
  • Login name
  • Name of the retrieved file,
  • amount of data transferred,
  • Message indicating whether the retrieval was successful.

The data is temporarily processed in a log file. Before storage, each data record is anonymized by changing the IP address after 4 days.

The anonymized data is stored on a server beyond the time of the visit to the website. We are obliged to do so on the basis of Article 6(1)(e) and (3)(b) of the General Data Protection Regulation (GDPR). This data is analyzed and required in the event of attacks on communication technology.

Data logged when accessing the Linkando GmbH website will only be transmitted to third parties if we are legally obliged to do so or if disclosure is necessary for legal or criminal prosecution in the event of attacks on communications technology. Data will not be passed on in other cases.

When individual pages are called up, so-called temporary cookies are used to facilitate navigation. These session cookies do not contain any personal data and expire at the end of the session. Technologies such as Java applets or Active-X controls, which make it possible to track the access behavior of users, are not used.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Legal basis for data processing

Access data

When you visit our website, personal data is processed in order to display the content of the website on your device.

In order for the pages to be displayed in your browser, the IP address of the end device you are using must be processed. Further information about the browser on your device is also required.

We are also obliged under data protection law to guarantee the confidentiality and integrity of the personal data processed with our IT systems.

For this purpose and on the basis of this interest, the following data is logged on the basis of a weighing of interests:

  • IP address in the event of incorrect access to Internet pages "Error Log" (for a maximum of 7 days)
  • Operating system of the calling computer
  • Browser version of the calling computer
  • Name of the retrieved file
  • Date and time of retrieval
  • Amount of data transferred
  • Referring URL

The IP address will be deleted from all systems used in connection with the operation of this website after 7 days at the latest. We can then no longer establish a personal reference from the remaining data.

The data is also used to identify and rectify errors on the website.

Contact form

We offer a contact form on our website that you can use to request information about our products or services or to contact us in general. We have marked the data you are required to provide in order to respond to an inquiry as mandatory fields. Information on other data fields is voluntary.

We need this information to process your request, to address you correctly and to send you an answer. In the case of specific inquiries, the data is processed to fulfill a contract or to initiate a contract. In the case of general inquiries, processing takes place on the basis of a weighing of interests.

Inquiries received via the contact form on our website are processed electronically by us in order to answer your inquiry. In this context, other persons or departments and possibly third parties may also become aware of the content of the form that you have sent.

The transmission of form data via the Internet takes place via encrypted connections.

Newsletter

You can also subscribe to an e-mail newsletter on our website. In addition to the voluntary information in the respective form, we only process your e-mail address. However, this is also mandatory in order to be able to send you the newsletter.

You can unsubscribe from the newsletter at any time. Alternatively, you will find a link to unsubscribe in every newsletter e-mail.

In order to be able to analyze the popularity of our newsletter mailings and optimize them, we log when emails are opened and links are clicked. This usage analysis is carried out on the basis of a balance of interests. You can object to this processing by unsubscribing from the newsletter.

When sending the newsletter, our service provider ("Chimpify") may also use service providers outside the European Union. In this case, the service provider ensures that the requirements for an adequate level of data protection within the meaning of Art. 44 et seq. GDPR are met.

Google Webfonts

We use so-called Google Web Fonts on our website. This involves loading fonts from Google servers to improve the design of the website. Data processing is carried out on the basis of a balancing of interests, whereby our interest lies in an appealing design of the website.

The fonts in question are loaded from Google servers, which are generally located in the USA. The appropriate level of data protection is guaranteed by Google ("Privacy Shield" list entry).

Purposes of the processing of personal data

We process the aforementioned data for the operation of our website and for the fulfillment of contractual obligations towards our customers or the protection of our legitimate interests.

In the case of inquiries from you outside of an active customer relationship, we process the data for sales and advertising purposes. You can object to the use of your personal data for advertising purposes at any time.

3. Web analysis

The web analysis tool "Stetic" is used on this website. The purpose of its use is the "needs-based design" of this website, which is carried out on the basis of a weighing of interests. The web analysis also enables us to recognize and correct errors on the website, e.g. due to incorrect links. Stetic uses so-called "cookies". These are text files that are stored on your computer and enable your use of the website to be analyzed.

a) Web analysis with Google Analytics

Processing purpose
This website uses Google Analytics, a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. ("Google"). b) Google Tag Manager

This website uses Google Tag Manager. This service allows website tags to be managed via an interface. The Google Tool Manager only implements tags. This means that no cookies are used and no personal data is collected. The Google Tool Manager triggers other tags, which in turn may collect data. However, the Google Tag Manager does not access this data. c) Google reCAPTCHA

We use the Google service reCaptcha to determine whether a human or a computer is making a certain entry in our contact or newsletter form. Google uses the following data to check whether you are a human or a computer IP address of the end device used, the website that you visit on our site and on which the captcha is integrated, the date and duration of the visit, the identification data of the browser and operating system type used, Google account if you are logged in to Google, mouse movements on the reCaptcha areas and tasks in which you have to identify images. The legal basis for the data processing described is Art. 6 para. 1 of the General Data Protection Regulation. e) Text chat and audio/video

The service provider Nexmo Inc., 501 2nd Street, Suite 310, San Francisco, CA 94107, USA (https://tokbox.com) is integrated for the electronic transmission of text messages, audio, video and screen sharing data. In order to set up the audio and video conference, technical information is transmitted to Nexmo Inc. by the Internet browser (e.g. IP address, browser type, set language, date and time) and, if necessary, used and statistically evaluated for the procedure. This data is processed separately, not assigned to any natural person and then regularly deleted.

f) Facebook visitor action pixel

Our website uses the visitor action pixel from Facebook, Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") to measure conversions. This allows the behavior of site visitors to be tracked after they have been redirected to the provider's website by clicking on a Facebook ad. This allows the effectiveness of Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimized.

The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy. This allows Facebook to place advertisements on Facebook pages and outside of Facebook. This use of the data cannot be influenced by us as the site operator.

Facebook Pixel is used on the basis of Art. 6 (1) GDPR. The website operator has a legitimate interest in effective advertising measures including social media. g) Integration of YouTube videos

We have integrated YouTube videos into our online offering, which are stored on https://www.YouTube.com and can be played directly from our website. These are all integrated in "extended data protection mode", i.e. no data about you as a user is transferred to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in paragraph 2 be transmitted. We have no influence on this data transfer.

We have also integrated content from the following third-party providers on this website: Google Maps and Google Web Fonts (external fonts).

h) Matomo

Scope and description of the processing of personal data
Our website uses the web analysis service Matomo, an open source solution.

Matomo stores cookies on your end device that enable your use of our website to be analyzed. The information collected in this way is stored exclusively on our server, namely the following data:

  • two bytes of the IP address of the user's calling system
  • the website accessed
  • the website from which the user accessed the website (referrer)
  • the subpages that are accessed from the accessed website
  • the time spent on the website
  • the frequency with which the website is accessed

Our website uses Matomo with the setting "Anonymize Visitors' IP addresses". This means that IP addresses are further processed in abbreviated form, thus excluding the possibility of direct personal identification. The software is set so that the IP addresses are not stored in full, but 2 bytes of the IP address are masked (e.g. 192.168.xxx.xxx). In this way, it is no longer possible to assign the shortened IP address to the calling computer. The IP address transmitted by your browser via Matomo is not merged with other data collected by us.

Legal basis for the processing of personal data
The legal basis for the processing of the user's data is Art. 6 para. 1 lit. f GDPR or § 15 para. 3 TMG.

Purposes of processing
We use Matomo to analyze the use of our website and individual functions and offers in order to continuously improve the user experience. By statistically evaluating user behavior, we improve our offer and make it more interesting for visitors.

Duration of storage
The data of the processing described here will be deleted after a storage period of 90 days.

i) Weglot

Functions of the Weglot translation service are integrated on this website. The provider is Weglot SAS, 138, rue Pierre Joigneaux in Bois-Colombes 92270 France. Weglot is loaded when the website is called up so that you can select your preferred language via the language icon in the header of the website. This enables a direct connection to be established between your browser and the Weglot server when you visit this website. Weglot then receives the information that you have visited this website with your IP address. The data is stored and analyzed on the basis of Art. 6 para. 1 lit. f GDPR. A corresponding consent is requested via the cookie and data protection settings of the website. The processing is then carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; consent can be revoked at any time. j) Appointment bookings

Integration of a Zoom booking calendar

On our website, we use a booking calendar from Zoom Video Communications, Inc. ("Zoom"), which is integrated via an iframe. This enables you to book appointments directly via our website.

If you use the booking calendar, personal data such as your name, your e-mail address, the dates you have requested and other information you have provided will be processed. The data is processed exclusively for the purpose of processing your appointment request.

The processing is carried out in accordance with Art. 6 para. 1 lit. b GDPR for the implementation of pre-contractual measures and in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in a simple and efficient appointment arrangement.

Data transfer to third countries:

When using the Zoom booking calendar, personal data may be transferred to the USA. There is no adequacy decision by the European Commission for the USA. However, Zoom uses EU standard contractual clauses to ensure an adequate level of data protection.

k) Email marketing with Lemlist & Snitcher

Use of Lemlist

We use the Lemlist software (operating company: Lemlist SAS, 128 Rue La Boétie, 75008 Paris, France) to organize, manage and evaluate our targeted email campaigns. Data such as name, e-mail address, company affiliation and usage behavior (e.g. opening and click rates) are processed. This is done on the basis of your consent (Art. 6 para. 1 lit. a GDPR) or on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for effective marketing and sales management. An order processing contract with EU standard contractual clauses has been concluded.

Use of Snitcher in conjunction with Lemlist

In addition, we use the Snitcher tool (Snitcher B.V., Netherlands) to analyze anonymized visitor data from our website and to collect companyographic information (e.g. company name, industry, location) or technical contact data (if available). The aim is to identify relevant leads and automatically transfer them to Lemlist for personalized outreach campaigns (email, LinkedIn, telephone).

Both tools process data within the EU. A guaranteed level of data protection exists through order processing contracts with associated EU standard contractual clauses.

Transmission to third countries:

Personal data (e.g. email addresses) may be transferred to third countries as part of processing operations - in all cases protected by EU standard contractual clauses or equivalent guarantees.

Storage duration:

  • Snitcher: max. 12 months for anonymized interaction data
  • Lemlist: up to 36 months after completion of the respective campaign or use

Your rights & revocation:

You have the right to information, rectification, erasure, restriction, data portability and objection. You can revoke your consent at any time with effect for the future - for example via the unsubscribe link in our emails, by email to datenschutz@linkando.com or via your customer account.

4. Processing of personal data for submissions and inquiries

In connection with submissions and inquiries, we only process data that is necessary to communicate with you and to properly document the business processes. This includes, in particular, personal information (e.g. surname, first name, address, e-mail address, etc.) that we have received directly from you as well as information about the contact method you have chosen (letter, telephone, e-mail, contact form). The processing of the data is necessary for the performance of our tasks (see Article 6(1)(e) and (3)(b) GDPR in conjunction with Section 3 BDSG).

We will only pass on the data we receive from you to third parties if you have expressly consented to this or if we are obliged to do so by law or on the basis of a court decision. The storage of submissions and inquiries in electronic form - as well as in paper form - is carried out in accordance with the statutory periods applicable to the storage of documents. As a rule, the retention periods for this are 10 years.

Data processing outside the EU takes place with regard to the sending of emails. Here, our service provider "Chimpify" uses the provider "Sendgrid". The necessary measures have been taken to ensure an appropriate level of data protection. The so-called EU standard contractual clauses, which can be found on the EU Commission's website, are used for this purpose.

5.Further processing of personal data

a) Newsletter dispatch

If you subscribe to the Linkando GmbH newsletter mailing list, your email address, the newsletter you have selected and optionally your name will be stored on a server. The data is processed on the basis of your consent in accordance with Article 6(1)(a) GDPR. We use this data to send the newsletter. We do not pass on your data to third parties and do not use it for any other purposes of our own.

When you register, your data is stored on a server and a confirmation message with a link to the final registration is generated and sent to the e-mail address you have provided. If you do not confirm the registration by clicking on the link in this e-mail, the data will be deleted after 7 days. Otherwise, your data will be deleted immediately when you unsubscribe from the newsletter.

b) Registration for Linkando GmbH events

To participate in Linkando GmbH events, you must generally register in advance. For organizational reasons, we must collect your first and last name, telephone number and email address in advance of the event in order to perform our duties in accordance with Article 6(1)(e) and (3)(b) GDPR in conjunction with Section 3 BDSG.

Film and photo shoots: At some events, photographs and films are taken as part of Linkaendo's press and public relations work. This is usually pointed out when entering the event. The recordings may be published on our website, social media channels, print media and other media.

The legal bases are Article 6(1)(e) and (3)(b) GDPR in conjunction with Section 3 BDSG and Section 23 Art Copyright Act. If you do not agree with the photographs and publications, please contact the photographer responsible for the subject search directly if possible.

c) Contacts with Linkando GmbH

If you contact Linkando employees or provide them with business cards, for example, personal data (names of contact details) will be recorded in address and contact directories - to the extent necessary for the further fulfillment of tasks - and deleted again as soon as it is no longer necessary, or as part of our data protection deletion concept.

6. Products provided by your organization - Note for end users

If you use a Linkando product with an account provided by an organization you are affiliated with, such as your work or association account, that organization may:

  • Control and manage your Linkando product and product account, including controlling the privacy-related settings of the product or product account.
  • Access and process your data, including interaction data, diagnostic data and the content of your messages and files associated with your Linkando product and product accounts.

If you lose access to your work or association account (for example, if you change employment), you may lose access to products and the content associated with those products, including those you have purchased in your own name if you have used your work or association account to log in to such products.

If your organization grants you access to Linkando Products, your use of Linkando Products may be subject to your organization's policies. You should direct your privacy requests, including any requests to exercise your privacy rights, to your organization's administrator. If you use social media features in Linkando products, other users in your network may see some of your activity. For more information about the social media features and other functions, please refer to the documentation or help content for the Linkando product. Linkando is not responsible for the privacy or security practices of our customers, which may differ from those stated in this privacy policy.

If you use a Linkando product provided by your organization, Linkando's processing of your personal data in connection with that product is subject to a contract between Linkando and your organization. Linkando processes your personal data in order to provide the product to your organization/association and to you, as well as for Linkando's legitimate business operations in connection with the provision of the product. As mentioned above, please contact your organization if you have any questions about Linkando's processing of your personal data in connection with the provision of products to your company/association. 7. Rights of data subjects

Linkando GmbH is responsible for the processing of personal data both in the context of fulfilling our tasks and as a contracting party under civil law. The data subjects therefore have the following rights under the GDPR:

a) Right of access - Article 15 GDPR

The right to information gives the data subject comprehensive insight into the data concerning him/her and some other important criteria such as the purposes of processing or the duration of storage. The exceptions to this right set out in §34 BDSG apply.

b) Right to rectification - Article 16 GDPR

The right to rectification includes the possibility for the data subject to have incorrect personal data concerning them corrected.

c) Right to erasure - Article 17 GDPR

The right to erasure includes the possibility for the data subject to have data erased by the controller. However, this is only possible if the personal data in question is no longer necessary, is being processed unlawfully or consent has been withdrawn. The exceptions to this right set out in §35 BDSG apply.

d) Right to restriction of processing - Article 18 GDPR

The right to restriction of processing includes the possibility for the data subject to prevent further processing of the personal data concerning them for the time being. A restriction occurs primarily in the review phase of other rights exercised by the data subject.

e) Right to data portability - Article 20 GDPR

The right to data portability includes the possibility for the data subject to receive the personal data concerning him/her from the controller in a commonly used, machine-readable format in order to have it forwarded to another controller if necessary.

f) Right to object - Article 21 GDPR

The right to object includes the possibility for data subjects to object to the further processing of their personal data in a particular situation, insofar as this is justified by the performance of public tasks or public and private interests. According to §36 BDSG, the right does not apply if a public body is obliged to process the data by law.

g) Right to withdraw consent

Insofar as the processing of personal data is based on your consent (Article 6 (1) (a) GDPR), you can revoke this consent at any time for the corresponding purpose. The lawfulness of the processing based on your consent remains unaffected until receipt of your revocation.

Possibility of complaint
